1. Introduction

Next Generation Travel Limited, is a company registered in England and Wales with company no. 07406226 and registered office address of Chiltern House, 181 Bristol Avenue, Blackpool, Lancashire, FY2 0FP. Next Generation Travel Limited has a number of wholly-owned subsidiaries (all with the same registered address) through which it conducts business. These are:

  1. WST Travel Limited, incorporated and registered in England and Wales with company number 02599533, trading as “WST Travel Limited”, “Galina International Study Tours” and “Study Experiences, Sports Experiences” and “Remembrance Travel for Schools and Young Persons;”
  2. Anglia Tours Limited, incorporated and registered in England and Wales with company number 04958490; and
  3. FHT Travel Limited, incorporated and registered in England and Wales with company number 04437559.

(referred to as "we", "us" or "our" in this Privacy Policy).

This privacy policy is issued on behalf of the Next Generation Travel Group so when we mention Next Generation Travel, "we", "us" or "our" in this privacy policy, we are referring to the relevant company in the Next Generation Travel Group responsible for processing your data. We will let you know which entity will be the controller for your data when you purchase a product or service with us.

We respect your privacy and are committed to protecting your personal data. This Privacy Policy will inform you as to how we look after your personal data when you visit our website (regardless of where you visit it from) or when you otherwise provide personal data to us via other means (such as over the telephone) and tell you about your privacy rights and how the law protects you. Please also use refer to the Glossary that we have set out at the end of the Policy, if there is any terminology used in this Privacy Policy that you are unfamiliar with or that you don’t fully understand.

We have appointed a data privacy manager who is responsible for overseeing questions in relation to this Privacy Policy. You have the right to make a complaint at any time to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection issues (ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO so please contact us in the first instance.

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). We may collect, use, store and transfer different kinds of personal data about you which we have grouped together follows:

  • Identity Data

This includes data relating specifically to your identity, such as your first name, maiden name, last name, username or similar identifier, marital status, title, date of birth and gender.

  • Contact Data

This includes data relating to how you may be contacted, such as your billing address, delivery address, email address and telephone numbers.

  • Financial Data

This include data relating to your means and methods of payment, such as your bank account and payment card details.

  • Transaction Data

This includes data relating to the transactions you have carried out with us, such as details about payments to and from you and other details of products and services you have purchased from us.

  • Technical Data

This includes more technical data that we may obtain when you make use of our website, such as your internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.

  • Profile Data

This includes the data that we receive when you create a profile on our website and make use of that profile, such as your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses. 

  • Usage Data

This includes information about how you use our website, products and services.

  • Marketing and Communications Data

This includes your preferences in relation to whether or not you want to receive marketing from us and our third parties and also your communication preferences.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we will treat the combined data as personal data which will be used in accordance with this Privacy Policy.

Special Categories of Personal Data

We collect the following special categories of personal data about you. Details about your:

  • dietary requirements which may disclose your religious or philosophical beliefs;
  • health;
  • race or ethnicity.

We collect and process the above data only where it is strictly necessary to do so in order to deliver the travel service that you have purchased. Furthermore, we will only collect and process the above special categories of sensitive personal data where you have provided us with your explicit consent to do so.

You are not under any obligation to consent to us processing your sensitive personal data. However, without your consent, we won’t be able to make the necessary arrangements to provide the travel services that you have booked or are attempting to book. As a result, if you do not provide your consent, we will be unable to proceed with your booking. 

If you are happy to consent to our use of your sensitive personal data, you will also be able to withdraw your consent at any time. However, as this will prevent us from providing the travel service you have booked, we will be required to treat any withdrawal of consent as a cancellation of your booking and the cancellation charges referred to in clause 12 of our Booking Terms and Conditions will become payable.

If you fail to provide personal data

Where we need to collect personal data by law or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you.

In other words, where we require details from you in order to provide you with your chosen travel services, if you do not provide us with the necessary details then we will not be able to provide the services you have booked or are attempting to book. 

In this case, depending upon when you fail to provide the necessary data, we may either not be able to process your booking or we may have to cancel your booking, in which case we will treat this as a ‘cancellation by you’ in accordance with our Booking Terms and Conditions clause 12. We will notify you if we are unable to process a booking or are required to cancel a booking for this reason.

We use different methods to collect data from and about you including through:

(A) Direct interactions

You may give us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

  • make a booking of travel services;
  • create an account on our website or online booking tools ;
  • subscribe to our newsletter or other publications;
  • request marketing to be sent to you;
  • enter a competition, promotion or survey; or
  • give us some feedback.

(B) Automated technologies or interactions

As you interact with our website, we may automatically collect Technical Data about your equipment, browsing actions and patterns.

We collect this personal data by using cookies, server logs and other similar technologies. We may also receive Technical Data about you if you visit other websites employing our cookies. Please see our cookie policy below for further details.

(C) Third parties

We may receive personal data about you from various third parties as set out below:

  • Technical Data from the following parties:
    1. analytics providers such as Google based outside the UK;
    2. advertising networks such as Google and Facebook based outside the UK; and
  • Contact, Financial and Transaction Data from providers of technical, payment and delivery services based inside the UK.
  • Identity and Contact Data from data brokers or aggregators such as The Education Company or D of E based inside the UK.

Please note that when using our website, you may be able to share information through social networks like Facebook and Twitter. For example, when you ‘like’, ‘share’ or review our services. When doing this, your personal information may be visible to the providers of those social networks and/or their other users. Please remember it is your responsibility to set appropriate privacy settings on your social network accounts so you are comfortable with how your information is used and shared on them. This will not be the responsibility of Next Generation Travel.

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Enter into a contract and deliver services for you
  • Comply with a legal duty
  • Protect your vital interests or the vital interests of those around you
  • For our own legitimate interests or those of other organisations, provided your rights don’t override these

We may send you emails about our company and other companies in our travel group. If you do not wish to receive this information you can unsubscribe from these emails at any time. Third-party marketing

We will get your express opt-in consent before we share your personal data with any third party for marketing purposes.

We may have to share your personal data with the parties set out below for the purposes set out in the table in paragraph 4 above.

  1. Internal Third Parties as set out in the Glossary.
  2. External Third Parties as set out in the Glossary.
  3. Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Privacy Policy.

Next Generation Travel has concluded Information Sharing Agreements with all key third-party providers however. Where we share your personal data with a third-party provider we will only disclose your information to the extent that it is necessary to allow them to perform the services they provide to us. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

International Transfers

Many of our external third parties are based outside the UK so their processing of your personal data will involve a transfer of data outside the UK.

Where you have requested a booking for travel arrangements which are located or otherwise due to be fulfilled outside the UK, we will have to transfer your personal data to the suppliers fulfilling or providing those travel arrangements outside the UK in order to make your booking and for those suppliers to be able to provide you with the travel arrangements you have booked. Where we are unable to rely on one of the safeguards outlined below when transferring data to those suppliers outside the UK, we will rely on the derogation under Article 49 of the UK GDPR in order to transfer your personal data to countries outside the UK (as the transfer relates to the performance of a contract for your benefit), and you hereby permit us to do so. You also acknowledge that where your personal data is transferred outside the UK, controls on data protection may not be as wide as the legal requirements within the UK.

Whenever we transfer your personal data out of the UK, we ensure similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data.
  • Where we use certain service providers, we may use specific contracts approved for use in the UK which give personal data the same protection it has in the UK.

We take the security of your personal data very seriously. We take reasonable precautions and follow industry best practices to protect your personal information and to make sure it is not lost, misused, accessed, disclosed, altered or destroyed. Emails containing your personal data sent to or from us will not be encrypted. You are free to make use of an encrypted service to share personal data if you wish or if it is your organisation’s policy to do so.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax,  accounting, or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for seven years after they cease being customers for tax purposes.

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

No fee usually required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond
We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Our telephone calls are recorded for quality and training purposes. They are kept for 12 months after which time they are deleted from our system.

When you click on the links on our website, they may direct you away from our site. Once you leave our website, or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service. We do not control these third-party websites and are not responsible for their privacy statements. We would therefore encourage you to read their Privacy Policy before using the third-party website.

YOUR LEGAL RIGHTS

You have the right to:

  • Request access

to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

  • Request correction

of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

  • Request erasure

of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it.
